Bush gave the order to use torture. He is responsible and therefore guilty of violating the Geneva conventions. It's also illegal under US law, as well.
I am not making the argument you assert in your second paragraph. I'm saying that the leader of nation who manufacturers evidence to support an illegal invasion of a country is responsible for the deaths that result from that invasion. For the last time I will state I don't think there will be any action taken on this issue. It will be the torture issue.
